Analyzing the differing conceptions of separation of power held by Publius and Anti-Federalists - Essay Example THE NECESSITY OF SEPARATION OF POWERS The idea of the necessity of limitation of powers within the framework of written Constitution was a basic premise shared by Federalists and Anti-Federalists alike. For instance, Cato argues that â€Å"a general presumption that rulers will govern well is not a sufficient security† (â€Å"Cato†), while Federalist James Madison observes that â€Å"the separate... exercise of the different powers of government... is admitted on all hands to be essential to the preservation of liberty† (â€Å"The Federalist No. 51†). At the same time, there existed views sceptical of universality of separation of powers. Centinel, an Anti-Federalist, considered the scheme of separation of state power into rival branches insufficient for the establishment of a truly democratic government (â€Å"Centinel†). In a sense, both Anti-Federalists and Federalists accepted the necessity of limitation of powers and of delineating the function s of different governmental bodies. Nevertheless, while Federalists ascribed higher qualities to the principle of separation of powers (â€Å"The Federalist No. 47†), the Anti-Federalists viewed it just as one of many, and not the most important, safeguards against the abuse of power. THE SEPARATION OF POWERS AND THE CONSTITUTION According to the Federalists, the separation of powers was to be maintained through the relevant organization of the internal structure of the government. The Federalist authors were convinced that by enabling independent agency to each â€Å"department† of government while simultaneously restricting their ability to interfere in proceedings of the other branches, the institution of truly republican government was perfectly feasible (â€Å"The Federalist No. 51†). Accordingly, the Federalists objected to the idea of recurrence to the people in the event of conflicts between the branches, cautioning against the strengthening of the legis lative power at the expense of the others (â€Å"The Federalist No. 49†). They found the independence of the judiciary especially important, warning against the possible encroachments by the legislature on the aforesaid independence (â€Å"The Federalist No. 78†). Anti-Federalists viewed the model of separation of powers established in the Constitution as abstract, pointing at excessive powers of the Executive and at the mixture of the executive and legislative branches of power found in the Senate (â€Å"Cato†). Both Cato and Centinel regarded the Senate as an aristocratic institution; whereas Cato proposed to institute direct election of the Senators and to establish annual rotation of its members (â€Å"Cato’), Centinel advocated the abolition of the Senate and the House of Representatives in favour of creating unitary federal legislature (â€Å"Centinel†). Theories of social disorder in contemporary UK society Compare and contrast any two theories of social disorder in contemporary UK society In UKs society, like in many other Modern societys Life is ordered in a certain way, They live in what is called a democratic society where everyone in theory has a voice and is heard and everyone gets to help pick who is in power or rather they get the freedom of making a choice. Those that are placed in power by the majority of the society in theory help maintain the social balance and laws that will govern that society in a certain way. This type of society is arranged in a certain order and those that live in this society are accustomed to life having an order and an acceptable set of rules in which they live within. This is social order an accepted Group belief on the ways of life in the society. The people who live in these societys are accustomed to its order and anything or anyone that disrupts their order are seen as a threat to their beliefs and on their ways of life these people are a seen as a disruptive or called and disruptive element and are said to bring disorder. Thi s behavior can be categorized as antisocial or Social Disorder. But who gets to decide on what is actually classed as order and what is classed as disorder? To be able to provide an answer to the question about theories of disorder in contemporary UK Society. An understanding of social order and where it comes from needs to be understood. Then looking at why social disorder is, and how it affects society on a whole. By doing so a better idea of UK societies is gained and why order is so important and why disorder can become such an issue to society. Looking first at Social order and how people get accustomed to order. People get used to their society working in a certain way it becomes a natural accepted way of life to them. But who decides on this way of life and what the order should be. An attempt can be made to try to show this by comparing and contrasting the works of two social scientists Erving Goffman and Michel Foucault (Silva pp.316). According to Geoffmans Apotheosis people come together in many ways. Society is not a separate entity with needs of its own but rather instead, society is a construction of many individual parts these parts made up of actions and interactions of many parts. Society is like a vast network of individual parts and that social order is caused by action put together by its individual parts. These are not repeated the same every time, as actions are made remade, worked and reworked all the time. This can simply best be summed up in saying. Interactional order creates social order (Silva pp 317). In comparison when the work of the social scientist Michel Foucault is looked at, He examined how the social order is organized and shaped. Foucault claimed society is made and remade through, power of discourses and authoritative knowledge. His apotheosis was that the dominant ways of thinking, Came from ether an authoritative entity, professionals and experts in positions of authority and that the order in society is made from alterative power and discourse. Foucault says that in any given historical period, ways of thinking and talking are organized in systems of discourses. These discourses can be seen as what determines the dominant ways of thinking and subsequently what the order in the society will be (Silva pp.319-324). In the comparison between the work of Geoffman and Foucault, They both have different apotheosis as has been shown earlier and both gave a strong explanation on how order is created in society and where it comes from. Both had their own merits but Foucault Seems apart from lacking to take the creative process of the individual into account uses a scientific basis to his apotheosis which helps to add to the validity of his claims and this builds a stronger apotheosis than the one put across by Geoffman. Now that a basic idea on what social order is has been gained its now time to take a look at what social disorder is, who creates it. To gain a better a basic idea of social disorder the works of the two social scientists Stuart Hall and Stanley Cohen, have been used and will be compared and contrast. So lets first look at what is social Disorder? Social disorder can be said to be any thing differing from normal. There is no universally recognized definition as to what contributes social disorder, disorderly/anti-social (which people are identified as anti-social or disorderly) or essential definition of certain things being right and others wrong. The definition of disorderly or anti-social is actually constructed in specific societies and therefore differs between places. Indeed, the very term anti-social is of relatively recent origin (Kelly, Toynbee.pp367-368). And such definitions are potentially an issue of conflict and power. This leads to the issue of the value-laden nature of defining disorderly/anti-social behaviors and people via law, social policy and media. A definition of disorderly/anti-social behavior is also a concept invoked by communities, an imagined we who judge some activities and people as disorderly/anti-social in the separated, yet overlapping, social spac e, Toynbee.pp368). Antisocial behavior has now become a catch-all term to describe anything from noisy neighbors and graffiti to kids hanging out on the street. Indeed, it appears that almost any kind of unpleasant behavior can now be categorized as antisocial or Social Disorder. Stanley Cohen puts forward the Apotheosis on social disorder that societys media over reacts to an aspect of a group or individuals behavior which may be seen as a challenge to existing social normality. However, the type of media response and the way it deals with the representation of that behavior will actually helps to define it, communicate it and portray it to society as a model for others to observe and adopt in their own way. He puts forward that the way group or individuals behavior represented in the media causes moral panic and that the fears generated are out of all proportion to the scale of the actual behavior which is the subject of the panic by society and will arguable fuel yet further sociably unacceptable behavior. (Kelly, Toynbee.pp378) Stuart Hall and his colleagues employing Cohens definition of moral panic theorized that the rising crime rate equation has an ideological function relating to social control. Crime statistics, in Halls view, are often manipulated for political and economic purposes. Moral panics (e.g. over mugging) could thereby be ignited in order to create public support for the need to police the crisis. this was the creation of a Law and Order society. The media played a central role in this new law and order Society in order to reap the rewards of lurid crime stories. After a period of stabilized consent the government relationship to the British society was starting to begin to crack and was coming to an end, in the form of social and political dissent. This dissent ranged from strikes and industrial unrest, intense political and military conflict in Northern Ireland, to the emergence of new social movements trying to promote or provoke social change. (Kelly, Toynbee.pp371) The British state those that are those in authority the most rich or powerful in society e.g. government, police, judges, politicians and lords used a crack down on crime and violence, particularly among young men of ethnic origin. This changed the status and the state it became a definer of disorder. The media then taking the cue from those in power made use of terminology, for instance the word mugging and extended it in society eyes, giving them a popular ring. This helped cover the deep-seated causes of social conflict, chiefly inequality, and the original social issues were now masked and turned into a moral and legal struggle e.g. violence. This was the birth of a Law and Order society'(Kelly, Toynbee.pp380) In conclusion in this essay it was shown what social order was and how it works and how disorder is made and used examples of how order works and about disorder was used to build a full picture. First by Geoffman who saw society as a network of individuals interacting. Then by Foucault who saw society as controlled and dominated by the powerful and authorities. Then we looked Stanley Cohen theories about media manipulating and escalating disorder in contemporary UK society and in part causing grater disorder in society. Then finally, Stuart Hall theory that social disorder was used as a way of manipulating issues and discord in society and that the media was used as a tool to suit there means. So to conclude society in UK is a democracy where we vote for who has the power then those who are in power use the media to manipulate and escalate to cover deep-seated causes of social conflict and they become the definers of what social disorder is and use it as required to keep stability in their society. A Story from My Memory: The Clash

Memories†¦ past events that tell the history of a person; this makes him or her unique from other people. Memories, if I think about it, I guess I do not have much of that. It is just the way it is for me. It is like my memories are easily removed from my mind so that not much of my history is left. However, despite this, there was this one night a long time ago that I would never forget.I believe it was in the year 1992, though my mind tells me that it is not sure whether it really was. Do you know the feeling of knowing the period in your life when an event happened, yet, at the same time, you are not sure of the time details? I think this is a great example for that. Somewhere in my brain, there is sureness that the event happened during my 5th or 6th year of life. The setting was Saudi Arabia, my homeland, and it was before the beginning of the Desert Storm.Just like every other siblings, my sister and I love staying up late. During that night we planned to stay up all night to chit-chat and play. We planned to do the stuff   normal girls enjoy. The night was beautiful and ideal for that. Children would have loved to enjoy that night, of course, without knowing the following events to happen.There were clear skies. As we lay in bed, there was a sudden flash of light coming from the window. It was really bright! The first thing that came into my mind was to know the source of the light. Without further thinking, I went out to see what that was, and there came what seemed to be the source†¦ it was an explosion. I saw a big explosion in the mid-air.My mind went haywire. As young as I was back then, I may say that I was really vulnerable and fragile. For a moment, I could not move and I was shocked at the huge explosion right in front of my eyes. Now that I think of it, I would surely say that it was no laughing matter, and it was completely nothing like what my sister and I had intended to do that night.The explosion that I saw was the second one a nd I was afraid of the next. I just knew that there was another one coming, and I was right. Ten seconds later, as I stayed to watch what happened next, there was a flying object coming from the same direction! In my mind, I was like saying, â€Å"Oh no! It might hit us!† and then, I saw something that flew from the ground, and it hit that flying object.It exploded! A clash! Voila! Another explosion right before my own eyes! The events were too much to handle. I was so young to see the bad things of the world.My body was pumped with adrenaline as I witnessed the event. I panicked and I was so afraid that all I can think of was to run to my parents’ room. When I reached their room, I saw my father trying to calm my mother. My father was from the military.He gave my mother directions on what to do. He said to her, â€Å"You should take the kids and go with your family out of the city.† Why did he tell her that? Why did we have to leave? My mind was full of questio ns but at the same time all I can do is follow. Afterwards, my father received a phone call from the military base. My father’s reaction was to wear his military uniform, say goodbye to us and leave.My mind, as young as it was, cannot fully understand the happenings that night. However, as the years passed, I learned that that moment was the beginning of the desert storm. It was also only after a while when I learned about the anti-missile system that was used to protect Saudi Arabia was the same thing that protected the people in our place from the ballistic missile heading near our home.The United States provided antiballistic defense during those times to protect the kingdom during the Gulf War. (ARCENT Saudi Arabia (ARCENT-SA) ) Without the protection, who knows what may have happened. I am very thankful that what I witnessed was a series of mid-air explosions instead of ground ones or else wide-ranged death may be my story here.My youthful mind can be said to be not as i nnocent as it may be. To me, the event was a mind-opening one. It made me aware of the nature of humans and the things that they do.   As I look at my young self, I may say that I have already witnessed the harshness of man-made evils that can really kill people. The missiles may not have harmed us physically, but emotionally and intellectually, there have been scars from that event. The mere thought of my father leaving for war where life is like always hanging in line is a very devastating idea for me.People can be harmed by the technology that man builds; at the same time, it can also protect them. The event in my life that I told is a part of my history, maybe not only mine, but also of others who have seen it. Now, as I brought my story to life through my writing, it made me more aware of my life. It made me realize that around us, disasters are possible, natural or artificial. Assignment: What is Diversity

I was asked to do an assignment where I have to question 10 students about what is the meaning of diversity because we hear so much about diversity. But when I asked people what they mean by it, I got different answers. Every time when I mentioned Diversity, it got a bad rap because some of them related it to affirmative action, and because there's a lot of fear surrounding it. So I noticed that the word conjures up negative feelings sometimes. While some were saying that diversity only refers to skin color, which is not always correct, others found it as a misconception. For them, it relates to differences in gender, race, religious background, ethnicity, age and background. It also differs from other aspects such as your educational level or your family status. You can find a lot of diversity in businesses and your children’s schools. But what they had in common was that Diversity affects our lives every day. Everywhere we go, no matter what city, state, or country you travel to, you will always be surrounded by diversity. This can be both a good and a bad thing. However, diversity is a part of our daily lives and it is something that we must learn to live with. I think that some of their answers applied to Diversity Myths because there were some of them who think that diversity is to be feared because it is measured in many different ways. A story that ends without a denouement is called an open narrative. Throughout The Odyssey, Odysseus’ gained authority due to the aid and power of others, which resulted in three phases of understanding: self-determination, courage, and having a greater vision in life. In order to understand these three phases, one must be able to conquer predominance from those who are less useful than others. While being physically strong, he lacked mental strength without the guidance of the gods. Odysseus was a loner, but once meeting up with others he became popular. Once he makes these friends he learns more about the subjects of daily life. They are the ones who have more predominance than others because they know more people and are more intriguing. Odysseus needed and used the help of others to gain more knowledge throughout the story. Once Odysseus has served enough time in a place against his will, he would be determined to leave that place. Odysseus’ journey towards home was now going to have the chance to come to and end. For seven years, Calypso held him prisoner on the island of Ogygia where he wanted to leave to seek the completion of his journey. Calypso agrees to let him go but first offers Odysseus some advice and guidance saying, "Only I will not aid [you] on [your] way, for I have no ships fitted with oars, nor crews to bear [you] over the broad ocean ridges; but I will freely give [you] counsel and not hide how [you] may come unharmed to [your] own native land"(Bloom, 47). Just as when bacteria invade the body, the immune system responds by developing antibodies to fight and destroy these foreign cells. The mother's immune system then keeps the antibodies in case the foreign cells appear again, even in a future pregnancy. The mother is now "Rh sensitized." In a first pregnancy, Rh sensitization is not likely. Usually it only becomes a problem in a future pregnancy with another Rh positive baby. During that pregnancy, the mother's antibodies cross the placenta to fight the Rh positive cells in the baby's body. As the antibodies destroy the red blood cells, the baby can become sick. This is called erythroblastosis fetalis during pregnancy. In the newborn, the condition is called hemolytic disease of the newborn. Hemolytic disease of the newborn (HDN) occurs due to maternal IgG antibodies crossing the placenta thereby producing hemolysis mainly due to Rh, ABO and Kell groups. A systematic approach to the Rh HDN involves an obstetric history of previous isoimmunized baby, timing and regular monitoring of maternal Rh antibodies and pigment assay of amniotic fluid. Timely decision regarding in utero transfusion and early termination of pregnancy based on the maternal monitoring has radically improved the outcome of these babies. Antenatal prophylaxis with anti D has resulted in great reduction in the magnitude of Rh problem. The fetal blood sampling and in-utero intravenous transfusions has made it possible for almost 100% survival of isoimmunized pregnancies without hydrops. Alternative methods--IVIG and plasma exchange are still of limited application. ABO HDN though common is not a serious form of disease and dose not warrants invasive antenatal monitoring. Anti-Kell is found in patients hav ing received multiple transfusions and the rapid progress of hemolysis in them may not allow such systematic follow up as in Rh HDN. (Narang A, Jain N, 2001).
